India gang-rape victim dies in hospital

The 23-year-old who was gang-raped in New Delhi and thrown from a bus has died from her injuries in Singapore, where she was being treated. NBC's Natalie Morales reports.

By NBC News and wire services

SINGAPORE ? A 23-year-old Indian woman who was gang-raped and severely beaten on a bus in New Delhi died Saturday at a Singapore hospital.

The woman's horrific ordeal galvanized Indians to demand greater protections against widespread sexual violence, and her death was expected to intensify public demands for action by the Indian government.

The victim who has not been identified,?"passed away peacefully" with her family and officials of the Indian embassy by her side," said Kelvin Loh, the chief executive of Mount Elizabeth Hospital, where she had been treated since Thursday. "The Mount Elizabeth Hospital team of doctors, nurses and staff join her family in mourning her loss," he said in a statement.

The woman and a male friend were traveling in a public bus after watching a film on the evening of Dec. 16 when they were attacked by six men who took turns raping her. They also beat the couple and inserted an iron rod into her body resulting in severe organ damage. Both of them were then stripped and thrown off the bus, according to police.

?

The woman was airlifted to Singapore on Dec. 26 for specialist treatment, but she had remained in extremely critical condition, Loh said.

The victim had already undergone three abdominal operations before arriving in Singapore, where her condition on Thursday was described as "extremely critical."

"Despite all efforts by a team of eight specialists in Mount Elizabeth Hospital to keep her stable, her condition continued to deteriorate over these two days," said Loh on Saturday. "She had suffered from severe organ failure following serious injuries to her body and brain. She was courageous in fighting for her life for so long against the odds but the trauma to her body was too severe for her to overcome."

Protesters call for execution

The attack triggered nationwide protest?over the lack of safety for women, culminating last weekend in pitched battles between police and protesters in the heart of the capital.

New Delhi has the highest number of sex crimes among India's major cities, with a rape reported on average every 18 hours, according to police figures. Government data show the number of reported rape cases in the country rose by nearly 17 percent between 2007 and 2011.

Prime Minister Manmohan Singh's government seemed at first caught off guard by the reaction to the attack, which sparked a blame game between politicians and the police.

On Saturday he said that he was aware of the emotions the attack has stirred and that it was up to all Indians to ensure that the young woman's death will not have been in vain.

"These are perfectly understandable reactions from a young India and an India that genuinely desires change," Singh said in a statement. "It would be a true homage to her memory if we are able to channel these emotions and energies into a constructive course of action."

He said the government was examining the penalties for crimes such as rape "to enhance the safety and security of women."

Indian television channels said security had been tightened in New Delhi on Saturday in anticipation of more protests following the woman's death.

Reuters and The Associated Press contributed to this report.

Protests continued across New Delhi, India, where around 500 people marched in response to the recent gang rape of a young woman. NBCNews.com's Dara Brown reports.

Shopping And Product Reviews

Shopping and Product Reviews are twins, they must go together. Going Shopping without the assist of Product reviews can direct you to a preferably fatal purchasing experience. When buying items either Online or on a genuine shop, it is great if you already know what you are aiming in line with the product you want to spend your money with. Other than, spend a minute or two to execute Product review before flinging your money on Shopping.

Some might think that buying leather briefcases or luxury briefcases are not as refined as it is. All you should do is go to the Shop, pick the one you want, or mind the proffers from the salesperson or from your dear friend. Wrong. Everything you like to purchase should to be double-checked first. Without prior knowledge on things that you would like to purchase, you might be slanged by fake retailers.

It is a fact that fakes are all over the place. Everybody knows that. What you do not know is how to find out whether what you are purchasing is an reliable leather hence worthy of its skyrocketing cost (leathers are really expensive). But as you found time to explore the net of what you are searching for, together with the info of how heavy is it, of the marks that can be determined on its body etc at least you have the knowledge of what to appear for when purchasing the item.

Imagine not knowing all of the information. You went home with the package on your hands, thinking that you have in your self control something that is little expensive when really what you had is near to a clone. Same endures with the price. Other stores take vantage of the lack of knowledge of their clients and would give a price way too costly than the actual one.

Animal rights group pays settlement in circus elephant case ...

(CNN) ? A circus producer said Friday that an animal rights group has paid it $9.3 million to settle two federal court cases claiming elephant abuse.

Feld Entertainment, Inc., trumpeted the settlement with the American Society for the Prevention of Cruelty to Animals (ASPCA) as a victory for its Ringling Bros. and Barnum & Bailey Circus.

?These defendants attempted to destroy our family-owned business with a hired plaintiff who made statements that the court did not believe,? said Kenneth Feld, chairman and CEO of Feld Entertainment, in a statement.

?Animal activists have been attacking our family, our company, and our employees for decades because they oppose animals in circuses,? Feld said. ?This settlement is a vindication not just for the company but also for the dedicated men and women who spend their lives working and caring for all the animals with Ringling Brothers in the face of such targeted, malicious rhetoric.?

The ASPCA was one of several animal rights groups that sued Feld Entertainment in 2000, alleging that circus elephants were abused.

Both parties filed dismissal papers in U.S. District Court for the District of Columbia. The matter has been in litigation for more than a decade.

The ASPCA confirmed the settlement, saying in a statement that ?the organization does not admit to any liability or wrongdoing.? The court never ruled on the merits of the elephant abuse allegations, it said.

?After more than a decade of litigating with Feld Entertainment, the ASPCA concluded that it is in the best interests of the organization to resolve this expensive, protracted litigation,? said ASPCA President and CEO Ed Sayres in the statement.

Feld?s cases, which include allegations of litigation abuse and racketeering, will continue against the other defendants ? the Humane Society of the United States, the Fund for Animals, the Animal Welfare Institute, the Animal Protection Institute United with Born Free USA and Tom Rider, a former circus employee who testified against Ringling Bros.

U.S. District Judge Emmett G. Sullivan deemed Rider?s testimony tainted because he had been paid by animal rights activists and did not have standing to sue.

?The court finds that Mr. Rider is essentially a paid plaintiff and fact witness who is not credible, and therefore affords no weight to his testimony regarding the matters discussed herein, i.e., the allegations related to his standing to sue,? he wrote in a December 2009 opinion.

CNN was not able to reach Rider on Friday.

ASPCA spokeswoman Elizabeth Estroff would not comment on specifics of the case.

Friday?s settlement did not placate Wayne Pacelle, president and CEO of the Humane Society of the United States.

?While HSUS was not a party to the original case against Ringling, we agree with so many critics of the circus that its treatment of elephants is deplorable and unacceptable. We?ll continue to make our case to the public, even as Ringling files frivolous and retaliatory legal actions to divert and distract from its abuse of elephants,? he said in a statement.

John Simpson, lead counsel for Feld and a partner at Fulbright & Jaworski in Washington, said Feld?s legal costs since July 2000 have exceeded $20 million, but that settlements with other defendants may be reached.

?We?re going to see this through to conclusion, whether it ends in a verdict or whether it ends in a settlement,? he said in a telephone interview. ?But they know where to find me.?

The toll of the case has gone beyond a financial one, he said. ?It gets very personal and nasty out there on the line when the company?s employees are handling the elephants in public on walks,? he said. ?I think the people who have cared for these animals have suffered and been unjustly accused.?

Mississippi River drops, threatening barge traffic

(AP) ? The Mississippi River's water level is dropping again and barge industry trade groups warn that river commerce could essentially come to a halt as early as next week in an area south of St. Louis.

The Coast Guard remains confident that the nation's largest waterway will remain open despite the worst drought in decades. But officials with the American Waterways Operators and Waterways Council Inc. said Thursday that even if the river is open, further limits on barges will halt commercial traffic.

Mike Petersen, of the Army Corps of Engineers, says ice on the northern Mississippi River is reducing the flow more than expected. The river level is now expected to get to 3 feet at Thebes, Ill., on Jan. 6, when new limits on barges could go into place.

36 Per Cent of 2012 Smartphone Sales were in China, says Informa

36 per cent of all smartphones sales this year were in China, according to research from Informa Telecoms & Media. 284m smartphones have been bought in the country in 2012, growth of 85 per cent between 2011 and 2012, making it the largest market in the world.

786m smartphones were sold worldwide, which is 45 per cent more than last year. Total global handset sales, including feature phones, is 1.5bn.

72 per cent of smartphone handsets worldwide are running Android, or 571m, with 32.9 per cent of those in China. Android has 66.1 per cent market share here - 187.7m handsets - although many do not fully comply with Google?s ecosystem. Informa believes that 41 per cent of these devices support alternative app frameworks, including Baidu, Alibaba, Xiaomi, Tencent, Wandoujia and Anzhi.

Half will be Android by 2015

The US is the second-largest market for Android with an 11 per cent share.? Informa anticipates that at least one in every two phones sold in the US in 2013 will be powered by this platform. By 2015 ? the company expects the same to be true globally.

Apple?s iPhone and Microsoft?s Windows Phone hold minority market share in China - around 5 per cent and 1 per cent. Windows Phone is expected to increase its share to 2 per cent next year, thanks to Nokia?s partnership with China Mobile, the largest network operator in the world. Informa predicts that the iPhone will lose market share here if Apple does not offer an LTE variant for the Chinese market.

Apple rots in US?

Malik Saadi, principal analyst at InformaMalik Saadi, principal analyst at InformaInforma warns that Apple?s sluggishness to upgrade its? ?ageing iOS? may see sales decline by 4 per cent in the US next year, from 35.5m to 34m. Microsoft is expected to slightly improve its market share here next year, to 6.5 per cent, as Nokia and HTC strengthen their Windows Phone partnerships.

?Android is expected to continue gaining market share globally and, by 2015, one in every two handsets sold worldwide will be powered by it. However, according to Informa Telecoms & Media, the market share of this platform could potentially peak ? or even decline ? after 2016 owing to a more aggressive penetration of the alternative OSs, most notably Windows Phone,? said Malik Saadi, principal analyst at Informa Telecoms & Media.

?Despite the economic downturn, the global smartphone market is enjoying healthy growth and consumers are actually spending more to acquire more technologically-advanced devices.?

The Unanswered Questions, 2012 Edition

A woman sunbathing topless near a pool.

Is this woman necessarily rich?

The Explainer has been busy as a bee in 2012, telling readers, first of all, whether bees are really all that busy to begin with. Another column reviewed the history of homework-eating dogs, and a third (this one may be cryptozoology) wondered if a wild leprechaun is scary, or is it cute? In the basement of the Explainatorium, our staff of Oompa-Loompas pored through dusty books and ran their zany algorithms, all to figure out why pizzerias bother with anchovies, and whether Band-Aids really work, and why the Central African Republic has such a boring name, and if people ever win that claw game at the carnival.

But the Oompa-Loompas have a meager constitution, and labor laws being what they are, not every question from our readers found its way into the column. The Explainer answered several hundred inquiries in 2012, while thousands more were left to slosh around untouched in holding tanks. Now we've pulled out some of these in deference to our year-end tradition and present you with a haul of topics that the Explainer felt unprepared (or perhaps unwilling) to address in 2012. As usual, we're hoping you'll let us know which of these imponderables is most deserving of an answer. The top vote-getter will be designated the Question of the Year, and a response will be posted in the coming weeks. (You can vote for only one option below, so click wisely.)

Previous Questions of the Year:

2011: Why are smart people usually ugly?

2010:?Why do boys like sticks?

2009:?If a Siamese twin commits murder, does his brother get punished, too?

2008: What is the most disloyal dog breed?

2007: Why don't we drop medical waste and nuclear waste into active volcanoes, the "ultimate high-temperature incinerators"?

2006: Can a bar of soap get dirty, or is it self-cleaning because it's soap?

STUDY: Marriage Equality Leads To Healthier, Happier Gays / Queerty

? HAPPILY EVER AFTER

A study published last Thursday in the American Journal of Public Health found that gay, lesbian, and bisexual people who are married have significantly lower levels of psychological distress when compared to their spinster counterparts.

According to the study:

Psychological distress was not significantly distinguishable among people in legally recognized same-sex or heterosexual relationships. There were, however, big differences in well-being between gay, lesbian, and bisexual men and women who were married and those who were not in any sort of legally recognized union.

The study is based on the 2009 California Health Interview Survey, which includes data from more than 47,000 hetero- and homosexual men and women, ages 18 to 70, regarding psychosocial distress, legal relationship status, education and employment status, as well as self-perceived overall health.

?One one level, it?s not surprising,? study author Allen LeBlanc, a professor of sociology at San Francisco State University, told ABC News. ?We know that heterosexual marriage provides a higher perception of social integration and support. It makes sense that same-sex marriages would carry some of the same benefits.?

The study comes shortly after the Supreme Court announced plans to review two marriage equality cases in the coming year, thus potentially altering the law of the land. UCLA?s Richard Wright, another author of the study, hopes the Supreme Court will take their findings into consideration.

?I think it?s reasonable to think that legally blocking people from marriage can put their mental health at risk,? Wright said. ?The Supreme Court should consider this when they?re mulling over this decision.?

Fresh Ideas To Help You Grow As A Person |

Friday, December 14th, 2012 at 8:34 pm ?

You can often learn a great deal about yourself from other people. Friends can help you, along with many good teachers and professionals who will explain your feelings and analyze your thoughts.

Know some common paths people have have taken to become successful. You can avoid both personal and business mistakes by knowing the trials that others have faced. Knowing what lessons have already been learned will positively affect your self improvement.

Take stock of your alcohol use to see if you are drinking too much. Do you harm your body through smoking, or in other ways? The body is considered a temple, and it needs to be treated with care and respect. Improve your life by eliminating unhealthy habits. Look at your life, what you are doing that may be harmful, and work on omitting things that need to be removed from your life.

Focus on making your time spent working as productive as possible. One thing that you should do is to take frequent breaks from your tasks. Taking breaks is not a waste of time. It will help you stay relaxed and focused on what you need to accomplish.

Staying positive takes a lot of willpower and it might mean that if you are positive towards others, then good things will come to you. For this reason, find it in your heart to always wish for the best things or outcomes for others. Thinking positively can decrease the burden of negativity.

Avoid working or exercising too hard, as these could exhaust you to the point that you fail to achieve your goals. While no one can argue the importance of giving 100 percent, you must nonetheless take care of yourself. If you push too hard to try and meet your goal too quickly, you may run the risk of injury. Not taking care of your body will actually make things worse over time, being very counter-productive to personal development.

Leadership is the first step to self improvement. While there are many different ways to describe leadership, the most popular definition centers on the ability to influence others. Understand the events in your life that make up your leadership journey. Which events had the most impact on the way you live your life? What changes did those events bring forth in you? How do you make yourself an important part of a team? Being able to answer these questions will help you realize how important you can be to your team.

Try to pay attention to your inner beauty and not outer. It doesn?t matter what you look like or the clothes you wear. It is the quality of your personality that will be the biggest measure of your life?s worth. Build your inner character rather than focusing on outside appearance.

You must take care of yourself if you expect to do a good job caring for others. Whether you?re just starting your self improvement plan or are well down the road and regardless of whether you?re succeeding or failing, you have to set aside time for yourself to rest, relax, and regroup.

There is nothing wrong with taking a little risk every now and then. It can be scary to go out of your comfort zone because of a fear of failing or rejection, though never taking risks will leave you unfulfilled. Furthermore, taking reasonable risks shows that you are brave. This boost to your self confidence will carry you far!

Praise others, flatter them, and show your appreciation. If you treat other people with kindness, you will be more likely to treat yourself with kindness too.

Always carry a way to write down thoughts you may have. Start out by carrying a small notepad whenever you go out. Write your thoughts down when they occur, and then you can refer back to them later when the time is right.

Find out more abut sexual capitol and how you can develop it. This does not mean using your sexuality to get what you want but rather using your charm. Good social skills, including a command of sexual capital, are not absolutely required, but they can take you further than you would get without them.

It is important that you get in touch with your real self and your desires. Be kind and true with yourself as you go through life, and feel good you have an understand of who you truly are.

How the Government Is Coming After Your IRA and 401(k) Plan

There are huge amounts of money in these plans, which makes it very tempting for government to try and get at it. The government may, or may not, tax the money, but there are other ways they may get at the funds.

An Investment Company Institute study published this month found that U.S. retirement assets totaled $18.5 trillion at the end of the second quarter 2012, of which 3.5 trillion was in IRAs and $5.1 trillion was in 401(k) plans.

World News Daily reports on how the government may try to expand the IRA program and then get its hands on that money:
Recent evidence suggests government officials continue to eye the multi-trillion dollar private retirement savings market, including IRAs and 401(k) plans, eyeing the opportunity to redistribute private retirement savings to less affluent Americans and to force the retirement savings out of the private market and into government-controlled programs investing in government-issued debt?Since 2010, the U.S. Treasury Department and the Department of Labor have been holding combined hearings on various plans designed to introduce government-mandated retirement plans and investment options, including government annuities invested primarily in U.S. Treasury debt, into the private retirement savings market.

?This hearing was set up to explore why Americans are not saving as much for their retirement as they could,? explained National Seniors Council National Director Robert Crone, describing a recent Treasury-Labor hearing held in the Labor Department?s main auditorium.

?However it is clear that his is just the first step toward a government takeover. It feels like the beginning of the debate over health care and we all know how that ended up.?

Speaking on condition of anonymity, two officials said forces of President Bashar Assad have fired the missiles from the Damascus area into northern Syria. These officials asked not to be named because they weren't authorized to discuss the matter publicly.

News of the missiles came on the same day that more than 100 countries, including the United States, recognized a new Syrian opposition coalition. That has further isolated Assad's regime and opened a way for greater humanitarian assistance to the forces battling to oust him.

One official said there was no indication that chemical weapons were aboard the missiles. Officials have said over the past week that they feared rebel advances were prompting Assad to consider using chemical weapons.

This official estimated that the number of?Scuds?fired was more than a half dozen, confirming details first reported by The New York Times.

State Department spokeswoman Victoria Nuland said Assad has fired missiles, but wouldn't specify what kind.

"As the regime becomes more and more desperate, we see it resorting to increased lethality and more vicious weapons moving forward and we have in recent days seen missiles deployed," she said.

White House press secretary Jay Carney, speaking to reporters, said he could not confirm the report, but said if true it would be a sign of desperation.

"The idea that the Syrian regime would launch missiles, within its borders, at its own people, is stunning, desperate and a completely disproportionate military escalation," Carney said.

In Brussels, a NATO official confirmed that the alliance's intelligence indicates the missiles were Scud-type missiles.

"Allied intelligence, surveillance and reconnaissance assets have detected the launch of a number of unguided, short-range ballistic missiles inside Syria this week," said the official, speaking on condition of anonymity to discuss intelligence matters. "We do not know the details of the missiles but trajectory and distance travelled indicate they were Scud-type missiles."

"The missiles were fired from inside Syria and they impacted inside Syria. No missiles hit Turkish territory. We have no information about possible casualties or damage," added the official.

The new development happened as officials planned an international conference to further assist opposition to Assad.

"This is the usual pattern of behavior that whenever there is an important decision that is anti-Assad taken by the international community, the Assad regime escalates the degree of violence to show its degree of displeasure," said Murhaf Jouejati, a specialist on Syrian affairs at the National Defense University. "Like saying, 'Oh, yeah? I'll show you!' "

Chilean town shaken by reminders of deadly quake

NAVIDAD, Chile (AP) ? One jolt hit in the middle of the night. Another caught fishermen at a nearby beach. Then the ground shook at supper. And then again, and again: More than 170 tremors were felt in Navidad in just five weeks. The strongest struck during a funeral, and sent panicked mourners fleeing into the street.

Navidad, a coastal farming town of 5,500 people, has become one of the shakiest spots in one of the world's shakiest countries. And seismologists can't say whether these were aftershocks from Chile's devastating quake two years ago, or warnings of another huge disaster to come.

Navidenos, though, have learned to take quakes in stride.

In this town whose name means Christmas, some decorate Christmas trees with quakes in mind, wiring ornaments to the branches or taking extra efforts to secure the base. Restaurant owners nail wood railings to their shelves to keep glasses and liquor from crashing down. Some now use canned beer, shunning bottles as too risky.

Children at public schools practice drills every day and everyone seems to have a quake bag with flashlights and food ready.

"We were born, grew up and were raised with earthquakes," acting Mayor Rodrigo Soto said. "It seems like the world for the first time has discovered Navidad. Everyone asks us if we're scared and all we can say is that we need to be prepared."

Still, no amount of preparation can avoid that panicky feeling when the ground really rumbles. There's no way to know at that moment whether the shaking will pass quickly, or become frighteningly worse.

While the ground shook under the pews at the funeral, the faces of the mourners turned pale like the dead. Despite appeals for calm, the church swayed so much that people panicked and ran outside.

"People were terrorized," said Carolina Jeria, recalling that 5.9-magnitude quake on Nov. 21. "In a moment like that, you lose control. We're very worried about the quakes because the big one in 2010 caught us unprepared."

Soto says the town still has an inadequate tsunami alert system ? a siren that sounds like a car alarm and lacks the volume needed to reach all the townspeople. But after so many tremors, he says Navidenos know in their bones when to run.

They know they'll barely feel a magnitude-2, but a magnitude-7 will knock them off their feet and that's a sign to scramble for high ground in case there's a tsunami.

Aside from the quakes, life is slow in Navidad. Many farmers still use oxen to plow their land, while others cater to tourists who come for the Pacific beaches from Chile's capital of Santiago, 170 kilometers (100 miles) northeast of town. Yet people are often on edge.

It's not just the ground's trembling that reminds people of earthquake risks here. Alongside the highway into town, wildflowers grow around tsunami warning signs that urge residents to build their homes high or be prepared to run for higher ground.

So far, the recent tremors have not caused damage or injuries, but they're a frequent reminder of the 8.8-magnitude quake and tsunami in 2010 that devastated much of Chile's coast, including Navidad. That quake killed 551 people, destroyed 220,000 homes and washed away docks and seaside resorts, costing Chile $30 billion, or 18 percent of its annual gross domestic product.

No Navidenos died, but nearly 200 homes were lost or severely damaged, and most townspeople had no power or water for a month.

"During the 2010 quake, the rupture zone reached all the way to Navidad. That's why seismologists at the Universidad de Chile indicate that these could be late aftershocks," Miguel Ortiz, national chief of the early alert center at Chile's ONEMI Emergency Office. He also said the recent shaking could be a harbinger of another huge quake to come.

A team of international scientists said the chance of a big, or even great, quake could have increased along a wide expanse of Chile's coast because of the 2010 quake. Their report in the journal Nature Geoscience last year concluded that it relieved only some of the stress accumulating underground since an 1835 quake that was witnessed and documented by British naturalist Charles Darwin.

Just off Chile's long coast, the Nazca tectonic plate plunges beneath the South American continent, pushing the towering Andes to ever-higher altitudes. The 2010 quake was so strong it changed time, shortening the Earth's day slightly by changing the planet's rotation. The strongest earthquake ever recorded also happened in Chile, a magnitude-9.5 in 1960 that struck about 500 miles south of Navidad and killed more than 5,000 people.

"What strikes me most about Chile is its beauty but also great potential for disasters ? from large earthquakes to volcanic eruptions, much like in California," said Paul Caruso, a geophysicist with the U.S. Geological Service.

"The big faults are responsible for the big earthquakes but also for beautiful mountains, active volcanoes, and a range of climates ? from very cold to deserts," Caruso said. "It's a fascinating place, especially for a geophysicist."

Navidenos have different ways of coping.

Retiree Carmen Delgado is so haunted by the 2010 disaster that she often stays awake trembling, anxiously waiting for the sun to rise so she can volunteer as a waitress at a local restaurant to keep her mind busy.

"People are afraid because in the past weeks it shook so much," said Karen Contreras, 18, a waitress at La Boca restaurant, near the mouth of a river that runs down to the ocean from the green hills surrounding the town.

"It's still trembling, but at least people know where to evacuate if it's strong," she added.

At the Divina Gabriela public school, children rush out of classrooms and line up at the sound of a rusty white bell each day. There's also an annual earthquake drill.

"I keep canned goods, a flashlight and batteries, because we're scared about these daily quakes," said Valentina Villagran, 11. "Every kid here knows they should run for the hills."

Evelyn Perez, 31, who's studying to become a teacher, was seven months pregnant when she was jarred awake in 2010. She dragged three kids up cold, dark streets without any emergency supplies. Now she keeps a quake bag at her door.

From his porch overlooking the Pacific, Hernan Cepeda, 82, recalls how the tsunami rolled toward him that night. He ended up clinging to the roots of bushes and losing his dentures, almost swallowed by the sea.

"I didn't return here until last year and now the tremors have brought back memories," Cepeda said. "It seemed like it didn't shake as much before. No one can tell what will happen next, but all you hear is that the next one will be an even bigger quake."

Mechanics Lien Importance Highlighted By Contractor Failure Rates

On December 12, 2012 Author?By Scott Wolfe Jr Mechanics Lien Importance Highlighted By Contractor Failure Rates

Failure rates of businesses after a 5 year period by industry sector, showing that after 5 years only 36.4% of construction businesses survive. Data compiled from the Census Bureau?s Business Dynamics Statistics by Scott Shane for Small Business Trends.

Hat tip to Mark Paskell of the Contractor Coaching Partnership blog for digging up a recent article from Small Business Trends reporting on the failure rates of construction businesses after a five year period. ? The article highlights a?statistic?that should strike fear into the hearts of credit managers at construction or supply companies across the United States: After a 5 year period, only 36.4% of new construction businesses survive.

That makes the construction industry one of the most volatile. Our readers shouldn?t think of this as much of a secret, as we?ve reported?similar?statistics?in the past, such as this post: ?High Debt Ratios In Building Supply Industry Means High Risk ? Can You Control The Risk?

So, what can you do about this?

The Contractor Coaching Partnership blog article focuses on what businesses must do to survive in the market and prevent itself from falling prey to this statistic. I, however, want to reverse the thought process and focus on what businesses must do to avoid being?financially?burned by a contracting company that goes belly-up.

when push comes to shove, it?s all about what frontend work your company has done to create loss-saving opportunities in these situations.
Just yesterday a client contacted me to advise that a good customer was filing for bankruptcy. The customer owed them nearly $100k. ?These situations repeat themselves day-in and day-out across the country in the construction industry, and when push comes to shove, it?s all about what frontend work your company has done to create loss-saving opportunities in these situations.

What can you do if your customer files for bankruptcy protections? ?If you didn?t preserve your mechanics lien rights you?ll be left fighting for scraps with other creditors in an expensive bankruptcy proceeding. ?Those with protected lien rights, however, will simply bypass the bankruptcy process and collect from property owners, bonds, property equity and more. ?It?s a no-brainer. ?Mechanic liens save the day in the face of a bankrupt client.

Savvy Apps releases Today Weather for iPhone

Savvy Apps releases Today Weather for iPhone

Savvy Apps, the geniuses behind Agenda Calendar and Buzz Contacts, have released a new type of app for them -- a weather app called Today Weather. Although weather apps aren't a genre that Savvy Apps is known for, they've done a great job with Today. It's simplistic, informative, and unique.

Today Weather consists of three different levels: the "Zoomed" level that allows you to edit your locations, the "Dashboard" that shows the main weather information at all your locations at once, and "Location" that has detailed weather information for the selected location including the 3-day and hourly forecasts, the high and lows, humidity level, windspeed, and more. To move up the levels, you simply tap the little arrow in the lower left corner.

From the Location level, you can swipe left and right to see even more. Swiping to the right will reveal the basic forecast over the next week. This isn't your typical forecast, however, as it is displayed as a bar graph where each bar represents both the high and low for the day. Swiping to the left from the main Location view will display the hourly forecast over the next 36 hours. Swiping up or down will navigate through your different locations.

If there is an alert for the location you're viewing, there will be an exclamation point next to the location's name. Tapping it will reveal detailed information about the alert. Also, the little map icon at the bottom left of the Location view will flip the screen around to reveal a map with a precipitation radar.

I've used a lot of weather apps in my time and Savvy App's Today Weather is a unique take on the popular category. Today Weather is definitely meant for the minimalists as it doesn't include detailed maps or multiple radars, and for those minimalists, Today is an excellent choice. I frequently have readers approaching me during their search for a weather app that displays the current weather conditions of multiple locations at once, and now I have the perfect app to recommend to them.
